“There are some things that are better than others,” he added.
California Rep. Steve Kamien, D-Sacramento, has sued the company in recent months after a federal judge ruled in favor of the company.
The state Rep. Kamien, who represents the rural, middle-class community of San Diego, accused the company of using its “obscene, illegal” ad to promote prescription drugs for erectile dysfunction drugs.
“The company has done everything it could to make the ad a better product,” he said in an e-mailed statement.
The lawsuit was filed in U. S. District Court, in Sacramento. Kamien is appealing the decision.
The company’s legal team will meet in person Monday for the hearing. The company will have to meet with state attorneys general and U. District Judge Rebecca Doherty.
